(Import & Export Rules 1963)

 Instructions to the applicants who intend to apply for the Certificate for exporting their products of Indian Made Foreign Liquor/ Beer for import into the State of Maharashtra.

1. The applicant / firm should submit their application in the prescribed form (to be obtained from the office of the Commissioner of State Excise, Maharashtra State, Mumbai), free of cost, affixing a court fee stamp of Rs.5/-.

2. The application form should be accompanied with all the documents and labels as specified in the application form.

3. If the Commissioner decides to grant the Certificate of Registration in favour of the applicant, the applicant shall pay a fee (inclusive of consideration) of Rs.7,26,000 ( changes from time to time) in the Government Treasury under Account Officer of State Excise, M.S., Mumbai, situated on 1st floor of the same building under the Head "0039/State Excise " and produce the receipt challan to the concerned officer.

4. The applicant shall produce all labels, crown corks, bung or seals with inscriptions prescribed in the condition (2) & (3) of the certificate with sufficient copies hereof for circulating to the district authorities.

5. The representative who will be dealing on behalf of the applicant shall have a power of attorney to deal with on behalf of the applicant and shall produce the same on demand.

6. Approval of Brands - The holder of certificate of registration granted under rule 9A shall apply to the Commissioner for approval of brands of each kind of liquor intended to be exported for import in the State of Maharashtra. On receipt of such application, the Commissioner shall make such inquiries as he deems necessary and on being satisfied that there is no objection to approve the brands, he may grant the approval thereof on payment of fees changes from time to time shown below namely :

1) Every brand of IMFL, have ex-manufactory price upto Rs.30/- per litre. Rs.5,000/- (Changes as per Govt policy)

2) Every brand of IMFL, have ex-manufactory price above Rs.30/- & below Rs.70/- per litre.Rs.7,000/- (Changes as per Govt policy)

3) Every brand of IMFL, have ex-manufactory Price of Rs..70/- & above per litre. Rs.10,000/- (Changes as per Govt policy)

4) Every brand of Beer & Wine Rs. 5,000/- ((Changes as per Govt policy)

K - Form

Registration of Exporters of Indian Made Foreign Liquor and Beer - Any manufacture of 

Indian Made Foreign Liquor and Beer having such manufactory or brewery located in a state other than Maharashtra, 

desire to export Indian Made Foreign Liquor and Beer in the state of Maharashtra shall make an application, 

addressed to the Commissioner for registration. Such application shall contain the following particulars namely :

Mandatory Documents With The Application

 

Name and address of the applicant. in case of an applicant which a form or a company, the name and address of the partners and Commissioners of such applications shall be accompanied with an attested copy of registered partnership deed, article of Association and memorandum of association (latest)

Number, date, and validity period of the manufactory or brewery licence, with an attested copy thereof 

Name of brand, stating whether such brand is a registered trade mark and the number and date of trade mark registration with a copy of trade mark registration with a copy of certificate of registration.

An understaking to the effect that the manufacturer undertakes to abide by the condition of the certificate of registration and the provisions of the Bombay Prohibition Act 1949, (Bom XXV or 1949) and rules, regulation and orders made thereunder. 

 

On receipt of the applicantion made under this rule, the commissioner shall make such enquires as he deems necessary and on being staisfied that there is no objection to grant the registration applied for, he may grant the licence in K form on payment of fees precribed by the commissioner time to time.

Brand  Registration Fees :

For every brand of IMFL, have ex-manufactory price upto Rs 30/- per litre ---Rs 5,000/- 

For every brand of IMFL, have ex-manufactory price above Rs 30/- and below Rs 70/- per litre ---Rs 7,500/-

For every brand of IMFL, have ex-manufactory price Rs 70/- per litre and above ---Rs 10,000/-

For Beer   and wine Rs 5, 000/-

Sub : Renewal of Certificate of Registration in form ‘K’ for the year 2008-09

Gentlemen,

                You are holding a certificate of registration under Rule 9(a) of the Maharashtra (Import/Export) Rules,1963, the validity period of which expires on 31st March,2008. According to the provisions contained in Rule (9) (D) of the said Rules, you are required to submit your application for renewal of the said certificate of registration to this office. You may, if you so desire, submit your application for renewal of the certificate of registration in the enclosed proforma with a court fee stamp of Rs.5/- affixed thereon enclosing the documents as mentioned in Rule 9(A) of the above mentioned Rules i.e. Challan denoting the payment of Rs. 7,98,600 (Rs Seven lacs ninety eigth thounds and six hundred only) as the fees for renewal as per Commissioner's Notification No. BPA 112007/2008-09/VII dated 10th January 2008. A copy of the manufactory/renewal licenses duly renewed for 2008-09 and the original certificate of registration in Form ‘K’ issued by this office. In addition to this, you have to pay the fees for registration of your brands as provided under Rule 9(B) of the above quoted Rules and produce the receipted challans along with your application.

2. The application shall be accompanied by statement in quadruplicate showing the particulars relating to the size of the container, the package and brands of liquor to be imported with manufacturing cost and M.R.P. of each size and pack. M.R.P.of IMFL imported in the State will be inclusive of all taxes and duties excluding sales tax as per Government notification No.ARM.1096/21/ PART-3/ EXC-3 dated 08.12.1998.

3. You are also required to submit details of Indian Made Foreign Liquor quantities exported to this State during the year 2007-2008 i.e. (01.04.2007 to 29.02.2008) in the proforma enclosed. The application duly completed in all respect should reach this office before 15th March 2008. You are further informed that in case your application with all the above documents is not received before the date, no import passes will be issued to the wholesalers for import of Indian Made Foreign Liquor manufactured by you.

4. You are also requested to supply a list of your distributors in the State. Any addition or deletion to the said list may be communicated from time to time.

5. You are further requested to inform whether the brands of Indian Made Foreign Liquor to be supplied to Maharashtra through your ‘K’ registration are manufactured in Maharashtra by any PLL licensee, if so name of the unit may please be informed. You are further informed that the export of said brands from Maharashtra to the State where your manufactory is located will not be allowed, please note.

2. The Superintendents of State Excise are informed that they should inform the foreign liquor wholesale licensees in their district to intimate to the holders of certificate of registration in form ‘K’ to get their certificate of registration renewed before 31st March 2008 from this office well in advance. They are also informed not to issue import passes permitting import of Indian Made Foreign Liquor beyond 25th March 2008 till the unit produces the duly renewed registration or till receipt of such instructions from this office.
